First Medtronic Infuse / Dr. Timothy Kuklo Lawsuit Filed in Saint Louis

Casey & Devoti has joined Kentucky attorneys David Gray and Brett Oppenheimer to file the first of many lawsuits in Saint Louis by patients concerning complications from Medtronic’s spine surgery product, Infuse. Similar cases have been filed across the country. Infuse is a liquid protein (BMP) that causes growth of bone.

The lawsuits allege, among other things, that Infuse continues to grow bone outside of the intended area, crushing nerves and blocking nerve pathways. Additionally, it is alleged that Medtronic, Inc., Medtronic Sofamor Danek USA, Inc. and several doctors, including Timothy Kuko, M.D., failed to properly disclose complications during the FDA-approval process.

    • The Spine Journal (for Orthopedic Surgeons) recently dedicated an entire issue to the Critical Review of BMP and “emerging safety concerns.”

    • The Senate Finance Committee recently completed its investigation and published a report.
