Personal Injury Accountability:
Who Pays when Negligence is Proved?

I was recently confronted at a family gathering. A family member was taken back by a note in one of our recent e-newsletters. The note concerned a successful outcome in an appeal of a case brought by our client against a teacher.

My relative was polite and gracious, but also a bit surprised. Surprised that I filed and prosecuted a case against a teacher. The inference underlying our discussion was that we weren’t doing ourselves any favors by publicizing our pursuit of a case against a teacher, a member of a profession dedicated to serving our children for relatively little pay.

The inference is based on a bad assumption—that the teacher will pay the judgment if the jury finds against the teacher and the court enters a judgment for our client.

Who Pays When There is a Judgment Against an Individual?

Insurance exists to protect people that make mistakes. Mistakes are inevitable; all of us make them. And, sometimes, the mistakes we make cause injury to others. Insurance helps spread the burden of the harms and losses resulting from our mistakes.

HEAT-RELATED ILLNESS: STAY SAFE & COOL THIS SUMMER

Extreme Heat

Everyone can be affected by excessive heat. However, there are certain populations who are more sensitive to extreme heat, these include: the elderly, people with chronic health conditions, low income families, infants and children, outside workers, and athletes.

To avoid heat-related illness, follow these tips:

  • Drink plenty of water throughout the day—don’t wait until you are thirsty
  • Avoid alcohol and sugary drinks
  • Wear loose, light-colored clothing and a large brimmed hat
  • Wear and reapply sunscreen
  • Schedule activities early in the morning or later in the evening—avoid midday
  • Use air-conditioning. If you don’t have air-conditioning, find a local cool-down shelter in your area
  • Don’t use your stove or oven to cook
  • Take cool showers or baths
  • Check on friends and neighbors; have someone do the same for you
  • Know the signs and treatment for heat-related illness

100 Deadliest Days for Teen Drivers

Automobile accident

Every parent experiences the same gut-wrenching feeling when their teen gets behind the wheel. As a personal injury lawyer, I have the unfortunate perspective of seeing the devastating aftermath of countless car crashes. My heightened sense of awareness gives me great pause now that my teens are learning how to drive.

With summer approaching, I wanted to make parents aware of the 100 deadliest days for teen drivers. From Memorial Day to Labor Day, it is estimated that nearly 1,000 people are killed in crashes involving teen drivers and, of those killed, 550 are teens.
