We handle most cases on a contingent fee basis. That means there is no attorneys' fee unless we are successful in recovering money for our client. We advance all expenses on behalf of our clients, but seek reimbursement for those expenses only if we are successful. Again, if there is no recovery, the client owes us nothing for the expenses we incurred.
33 1/3% is the most common contingency percentage. But, sometimes the percentage is more such as in a complex medical malpractice case. And, sometimes the percentage is less such as in a Workers Compensation case. Occasionally, a client prefers to retain us on an hourly basis (win, lose or draw) rather than on a contingency basis. That is always an option.
We discuss fees at the time of our initial conference with the client. Fee agreements are always put in writing and the client is provided with a copy of the agreement.
